1. Prices and Tax
The prices payable for goods that you order are as set out in the Blue Whale Gifts website. The price shown for the goods excludes postage and packing unless specifically stated. The charges for postage and packing are shown in the Checkout once you have entered the country and method of delivery and before you are asked to confirm the order. The price you pay will include VAT for all deliveries within the European Union. For deliveries outside EU, VAT will be deducted from the total price. Delivery to non-European countries may result in import duties payable on receipt of the goods. You will be liable for these duties.
We try to ensure that all the prices shown on this website are correct. However, occasionally products are mispriced. Where a product's correct price is lower than the stated price we will issue a refund for the difference and despatch the order in the usual way. Where a products correct price is higher than the stated price we will inform you of the correct price and give you the opportunity to proceed with the order at the correct price or cancel the order. Where a reduced price is shown the item(s) have previously been on sale at the higher price for 28 days or more.

3. Cancellation & Returns Policy
If you have a change of heart after placing an online order with us, for whatever reason, you may cancel your order any time up until the point of dispatch. If your request is entered after the dispatch of your order, the goods will need to be returned to us before your order can be reimbursed. Please see our Returns Information below for more details. To cancel your order, simply advise us via e-mail (sales@bluewhalegifts.co.uk) or telephone (+44 1554 754403).
Once we receive and acknowledge the cancellation request, you will receive a full refund using the same method as your original payment.
4. Our Cancellation Policy
We reserve the right to cancel an order if one or more of the following apply:
- We have insufficient stock to deliver the goods you have ordered
- We cannot obtain payment
- There is a fault in either the product or its description
- We are physically unable to delivery to your location
If we do cancel your contract we will notify you by email and will credit to your account any sum deducted by us as soon as possible but in any event within 30 days of your order.
We reserve the right to withdraw any products from this website at anytime and/or remove or edit any materials or content on this website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product from this website whether or not that product has been sold; removing or editing any materials or content on the website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

The colour of goods may vary slightly from that shown on the website due to limitations of photography equipment, computer software or hardware

All confidential information, including credit card details, are held securely and only transmitted in encrypted form. Your details may be passed to third parties only as required to complete your order and in accordance with the Data Protection Act and GDPR. See our privacy page for more details.
7. Jurisdiction
The Contract will be governed by the laws of England and Wales and the parties to the Contract submit to the jurisdiction of the English Courts.

None of the above Terms and Conditions affects your statutory consumer rights.
